我国推进反家庭暴力立法进程及需要解决的重点难点问题

摘要：中国的反家庭暴力立法经历了四个发展阶段，并取得积极进展。从1995年世妇会之前的无家庭暴力概念到2012年后将制定专门的反家庭暴力法列入国家立法规划，中国在推进反家庭暴力立法的过程中，有诸多需要解决的重点和难点问题，解决好这些问题，对于制定反家庭暴力立法具有重要意义。

The Critical Issues in the Legislation Progress of Anti-domestic Violence Law

Abstract：China’s anti-domestic violence legislation has gone through four stages of improvement. From 1995 the World Women Conference till 2012，the anti-domestic violence legislation developed through blank concept till specialized law progress. During the past years there were many difficulties to be resolved，and the resolution to these issues has great influence on the legislation progress of anti-domestic violence law.

家庭暴力是一个在世界范围内普遍存在的社会问题，受到国际社会的广泛关注。与其他国家一样，中国存在家庭暴力问题，具有一定程度的普遍性和严重的社会危害性。国外的实践证明，制定专门的反家庭暴力法是防治家庭暴力的最有效措施之一。党和政府高度重视家庭暴力问题，已经启动国家级反家庭暴力立法工作。本文主要关注我国反家庭暴力立法的进程和需要解决的重点难点问题。
